Terms and Conditions
For the purpose of these TERMS & CONDITIONS, the following words shall have the following meanings:
a) “The Company / Us /We” shall mean XBG Plumbing & Heating Limited.
b) “The Customer / You” shall mean the person or organisation for whom we agree to carry out works and / or supply materials.
c) “Our Representative / Engineer” shall mean the person we send to you to undertake the work.
Fixed Price Work:
Quotes will include labour and materials. The price will be fixed, but manifest errors shall be exempt.
Quotes may need to be revised if you change the specification of the works, if there is a change in the price of materials, or if further
works turn out to be needed to complete the job that were not anticipated at the time of the quotation. If it is impossible for us to do the
work for the previously quoted fixed price, we give you a free quotation for the work so that you can choose to use us or not. You will be
kept informed of any charges for the additional works carried out from the original quotation.
Jobs charged on Time and Materials basis:
The total charge to you will be the time spent by our Representative or Engineer to complete
the job. A minimum of 1 hour will be charged and then to the nearest 30 minutes. It will include all reasonable time spent in obtaining
materials. Parts and materials supplied by us will be charged at the trade price plus a 20% handling charge. You will not be charged for
time spent on breaks or for time our Engineer’s spend making telephone calls not directly related to your job.
Collecting Materials for the job:
We try to minimise collection of materials by carrying everyday stock items. In the event that we do need to collect materials we will always try to keep the
time to a minimum by using local stockists where possible. If the time is likely to be over 30 minutes you will be informed before our Engineer leaves the
premises. Only one person will leave to collect parts at any one time. Time spent collecting materials that we consider to be everyday stock items will NOT
be charged for. Parts and materials supplied by us will be charged at the trade price plus a 20% handling charge.
Invoice Terms:
Invoiced are payable IMMEDIATELY at the end of each job. Unpaid invoices (in total or part) will, at our discretion carry interest at 4% over The Company’s banker’s base rate while any payment remains outstanding
Time Keeping:
We will make every effort to attend each job on the date and time slot that was agreed with you. However, we cannot accept any liability for either arriving late or not at all (e.g.: sickness) or for the late delivery or failure to supply materials.
The Customer:
You as the point of contact will be personally deemed to be our customer and liable for the invoice, unless it is made clear to us who the customer is when the job is arranged.
Cancellations:
Should you instruct us to do works or order any parts on your behalf and then cancel, we reserve the right to charge you for any time spent and materials used or restocking charges we may incur on returning parts to stockist. Should you cancel a job that you have paid a deposit for within, 24 hours of the scheduled date, we reserve the right to charge you for time spent and restocking charges for parts to be returned to the stockist.
Guarantee:
The guarantee for all labour in respect of workmanship is 12 months. All parts and materials used will be covered by the manufacturer’s warranty in force:
All guarantee’s will be void if the work or materials supplied by us be:
a) Subject to abuse or negligence
b) Repaired, modified or tampered with by anyone other than XBG
c) We will not be able to offer any form of guarantee to any materials or parts that you have supplied and will accept no liability for any consequential damage or fault caused by them.
d) The Company cannot guarantee (due to its nature) any work to unblock any waste pipe work and drainage systems.
e) The Company cannot guarantee work under instruction from the customer and against the written or verbal advice of the company.
f) Work is only guaranteed following full payment of the relevant invoice.
g) The Company shall not be held responsible for any damage or defect resulting from work that is not fully guaranteed or from where recommended work has not been carried out.
h) The Company will be solely liable for any hazardous situation in respect of the Gas Safe Regulations or Gas Warning Notice issued.
Complaints Procedure:
Should you not be satisfied with any of the work carried out, you must contact us, in writing, within 12 months of the invoice date and let us come to inspect the work, and carry out the necessary remedial work at our expense. You agree that if you do not contact us with 12 months of the invoice date then we shall have no liability.
